Commercial Rent Arrears Recovery (CRAR) & Forfeiture of Lease in Manchester
Commercial Tenant Problems in Manchester? We Can Help
Unpaid commercial rent can quickly become a serious issue for landlords, particularly when arrears continue to build and communication with the tenant is no longer resolving the problem.
For landlords who want to recover qualifying commercial rent while keeping the tenancy in place, Commercial Rent Arrears Recovery (CRAR) may provide an appropriate enforcement route. Where recovering possession is the priority, forfeiture of the commercial lease may instead need to be considered.
Absolute Enforcement assists commercial landlords, managing agents and property professionals with commercial tenant matters across Manchester, from the city centre and Salford through to areas such as Trafford, Stockport and Tameside.
Our team can discuss the circumstances surrounding the tenancy and help identify the appropriate enforcement route before an instruction proceeds.
Commercial Tenant Not Paying Rent in Manchester?
When a commercial tenant stops paying rent, allowing arrears to continue accumulating can place additional pressure on the landlord and the wider management of the property.
CRAR provides landlords with a statutory procedure for recovering qualifying commercial rent from tenants in qualifying circumstances. Where the statutory requirements are satisfied, a court judgment is not normally required before the CRAR process can be used.
Importantly, CRAR focuses on recovering qualifying unpaid commercial rent rather than bringing the lease to an end. This means the tenant can remain in occupation and the commercial lease can continue.
Absolute Enforcement can assist landlords dealing with commercial rent arrears throughout Manchester and the surrounding area, helping them understand the enforcement options available and how to proceed.
Commercial Rent Arrears Recovery (CRAR) in Manchester
CRAR may be appropriate where a commercial tenant remains in occupation and qualifying rent is outstanding under a qualifying commercial lease. It provides landlords with a statutory enforcement procedure specifically focused on the recovery of qualifying commercial rent.
Once the relevant requirements have been satisfied, Certificated Enforcement Agents can attend the commercial premises as part of the enforcement process. The precise approach will depend on the circumstances of the instruction and the property concerned.
Manchester has a diverse commercial property market, ranging from city-centre offices, shops, restaurants and hospitality premises to warehouses, industrial units, workshops and business parks across the wider urban area. CRAR can apply to different types of commercial premises where the necessary legal requirements are met.
Landlords who need more detailed information about eligibility, the CRAR process and current costs should refer to Absolute Enforcement’s main Commercial Rent Arrears Recovery page or speak directly with the team before proceeding.
Need to Regain Possession of Your Commercial Property?
Recovering outstanding rent is not always the landlord’s main objective. In some circumstances, the priority may instead be to recover possession of the commercial property and bring the existing lease to an end.
Where the landlord has a lawful right to forfeit, commercial lease forfeiture may provide an appropriate route. Whether forfeiture is available will depend on factors including the terms of the lease, the nature of the breach and the circumstances surrounding the property and tenancy.
Commercial properties can present very different possession challenges. A single retail unit or office may require a different approach from a larger warehouse, industrial property, hospitality venue or more complex operational site.
Absolute Enforcement can assist with both straightforward and more complex commercial possession instructions, helping landlords consider the practical enforcement requirements before action is taken.
CRAR or Forfeiture: Which Route Should You Take?
CRAR and forfeiture serve different purposes. CRAR normally focuses on recovering qualifying unpaid commercial rent while allowing the lease and tenant’s occupation to continue. Forfeiture normally focuses on recovering possession and bringing the commercial lease to an end where a lawful right to forfeit exists.
The choice between these remedies should be considered carefully because taking one course of action can affect the availability of another. Landlords who are considering both rent recovery and possession should therefore speak to the enforcement team before proceeding.

I had an issue with someone claiming to provide a work visa for a friend, it was not materialising and upfront payment was not refunded. It was like a scam and i had to go through county court to get the money back as the person was not willing to repay or respond. I had applied for claim and county court provided judgement in favour of my claim and the claimant was still not repaying. The county court advised to go through one of the approved collection agency to get the money back. I had found Absolute Enforcement from the list and contacted them about my case, they advised to make an application with them to recover the money with further court order from higher court that they did for me with the county court judgement. It took about an year to go through the process and recover the money. Finally it was recovered and Absolute Enforcement provided updates on the process and progress and recovered the money as expected. So highly recommend Absolute Enforcement service for similar money claims that requires collection agency.Posted on Google![]()
