Commercial Rent Arrears Recovery (CRAR) & Forfeiture of Lease in Liverpool

Commercial Tenant Problems in Liverpool? We Can Help

Unpaid commercial rent can quickly become a serious issue for landlords, particularly where arrears continue to build while the tenant remains in occupation. Absolute Enforcement assists commercial landlords, managing agents and property professionals dealing with tenant problems across Liverpool.

Where the priority is recovering qualifying commercial rent while keeping the tenancy in place, Commercial Rent Arrears Recovery (CRAR) may provide an appropriate enforcement route.

In other circumstances, recovering the arrears may no longer be the landlord’s main objective. Where there is a lawful right to forfeit, the landlord may instead be considering forfeiture of the commercial lease and recovery of possession.

From commercial premises in Liverpool city centre and the waterfront to properties in areas such as the Baltic Triangle, Knowledge Quarter, Speke and north Liverpool, our team can help landlords consider the circumstances and identify the appropriate enforcement route.

Commercial Tenant Not Paying Rent in Liverpool?

When a commercial tenant stops paying rent, allowing arrears to continue can place increasing pressure on the landlord and the management of the property.

Commercial Rent Arrears Recovery may enable a landlord to recover qualifying unpaid commercial rent by instructing Certificated Enforcement Agents. Where the statutory requirements are satisfied, a court judgment is not normally required before CRAR is used.

Importantly, CRAR is generally a rent recovery remedy rather than a possession remedy. This means it may be suitable where the landlord wants to recover qualifying arrears while allowing the commercial lease and the tenant’s occupation to continue.

Absolute Enforcement assists landlords and property professionals with CRAR instructions throughout Liverpool and can help establish whether the circumstances are suitable for enforcement.

Commercial Rent Arrears Recovery (CRAR) in Liverpool

CRAR is a statutory procedure available in qualifying circumstances where commercial rent remains unpaid and the tenant remains in occupation of commercial premises.

Once the necessary requirements have been satisfied, Certificated Enforcement Agents can be instructed to pursue qualifying commercial rent from the tenant using the CRAR procedure.

Liverpool contains a broad range of commercial premises, from city-centre shops, offices and hospitality businesses to warehouses, workshops, industrial units and business premises in areas such as Speke, Garston and along key commercial corridors.

Eligibility depends on the individual circumstances, including the nature of the lease, premises and sums outstanding. Landlords should refer to our main Commercial Rent Arrears Recovery page for more detailed information about CRAR eligibility, the enforcement process and current costs.

Need to Regain Possession of Your Commercial Property?

Recovering unpaid rent is not always the landlord’s primary objective. There are situations where the commercial relationship has deteriorated to the point that regaining possession of the premises becomes the priority.

Forfeiture may be an appropriate option where the landlord has a lawful right to forfeit the commercial lease. Whether that right exists, and the appropriate procedure to follow, will depend on factors including the terms of the lease, the nature of the breach and the circumstances surrounding the property and occupation.

Commercial premises can also present very different enforcement considerations. Recovering possession of a straightforward retail unit can require a different operational approach from dealing with a substantial warehouse, hospitality venue, industrial site or other complex commercial premises.

Absolute Enforcement can assist with both straightforward and more complex commercial possession instructions. Where forfeiture is being considered, the circumstances should be reviewed before enforcement proceeds.

CRAR or Forfeiture: Which Route Should You Take?

CRAR and forfeiture are separate remedies with different objectives.

CRAR normally focuses on recovering qualifying unpaid commercial rent while allowing the lease to continue. Forfeiture normally focuses on recovering possession and bringing the commercial lease to an end where the landlord has a lawful right to forfeit.

The choice of remedy matters because taking one course of action may affect the availability of another. Liverpool landlords considering both rent recovery and possession should therefore speak to our enforcement team before proceeding so that the intended outcome is clear.

The Baltic Triangle has developed as a mixed-use creative and digital business district, creating a distinctly different commercial environment from Liverpool’s traditional central business areas.

Outside the immediate city centre, commercial premises extend through areas including Speke, Garston, Wavertree, Edge Lane, Aintree and north Liverpool. This creates a broad mix of landlord requirements, from individual retail and hospitality premises to offices, warehouses, workshops and larger industrial properties.

Commercial Enforcement Coverage From Liverpool City Centre to Speke and North Liverpool

Liverpool’s commercial property is spread across areas with very different characteristics. The city centre includes established retail, hospitality and office locations, while districts such as the Baltic Triangle and Knowledge Quarter combine newer workspace, specialist sectors and mixed commercial development.

The city’s commercial landscape changes again towards its outer districts. Speke and surrounding areas include substantial business, industrial and employment locations, while the Edge Lane corridor and areas of north Liverpool contain a mixture of retail, warehouse, industrial and other commercial premises.

This means enforcement instructions can range from a landlord dealing with a single shop or office to managing agents and property professionals responsible for multiple premises across different parts of the city. The property, lease, tenant circumstances and landlord’s intended outcome all need to be considered when determining the appropriate approach.

Absolute Enforcement provides commercial landlord enforcement across Liverpool as part of our wider England and Wales operation. We can therefore assist with individual local instructions as well as portfolios containing properties across multiple regions.

I had an issue with someone claiming to provide a work visa for a friend, it was not materialising and upfront payment was not refunded. It was like a scam and i had to go through county court to get the money back as the person was not willing to repay or respond. I had applied for claim and county court provided judgement in favour of my claim and the claimant was still not repaying. The county court advised to go through one of the approved collection agency to get the money back. I had found Absolute Enforcement from the list and contacted them about my case, they advised to make an application with them to recover the money with further court order from higher court that they did for me with the county court judgement. It took about an year to go through the process and recover the money. Finally it was recovered and Absolute Enforcement provided updates on the process and progress and recovered the money as expected. So highly recommend Absolute Enforcement service for similar money claims that requires collection agency.

Company was very professional and although it was a long process all was sorted. The agents that went on the collection were very professional and fair and unbiased. Office staff kept me up to date and made frequent calls to ensure I knew what was happening during the process.
