Commercial Rent Arrears Recovery (CRAR) & Forfeiture of Lease in Suffolk

Commercial Tenant Problems in Suffolk? We Can Help

Unpaid commercial rent can quickly create cash-flow problems for landlords, particularly where arrears continue to build while a tenant remains in occupation. Absolute Enforcement assists commercial landlords, managing agents and property professionals across Suffolk with appropriate enforcement options.

Where the priority is recovering qualifying commercial rent while the lease continues, Commercial Rent Arrears Recovery (CRAR) may provide an appropriate route, subject to the statutory requirements being met.

In other circumstances, recovering the premises may be more important than recovering the arrears. Where the landlord has a lawful right to forfeit, commercial lease forfeiture may be considered as a route to regain possession.

From Ipswich and Felixstowe to Bury St Edmunds, Lowestoft, Stowmarket, Newmarket and surrounding areas, our team can discuss the circumstances and help identify the appropriate enforcement route before an instruction proceeds.

Commercial Tenant Not Paying Rent in Suffolk?

When a commercial tenant falls behind with rent, landlords need to understand the enforcement options available and whether the circumstances meet the relevant requirements.

Commercial Rent Arrears Recovery, commonly known as CRAR, can allow a landlord to recover qualifying unpaid commercial rent through Certificated Enforcement Agents. Where the statutory requirements are satisfied, a court judgment is not normally required before the CRAR process is used.

Importantly, CRAR is a rent recovery remedy rather than a possession procedure. The commercial lease can remain in place while enforcement action is taken to recover qualifying rent.

Absolute Enforcement assists landlords across Suffolk with commercial rent arrears, helping them assess whether CRAR is appropriate before moving forward with an instruction.

Commercial Rent Arrears Recovery (CRAR) in Suffolk

CRAR may be available where qualifying commercial rent remains unpaid and the relevant statutory conditions are satisfied. It is commonly considered where the tenant remains in occupation and the landlord wants to recover rent rather than bring the tenancy to an end.

Once properly instructed, Certificated Enforcement Agents can undertake the enforcement process in accordance with the applicable legislation and procedure.

Suffolk has a varied commercial property market, ranging from shops, restaurants and offices in its towns to industrial units, warehouses, workshops, business parks and logistics premises. CRAR can apply across different types of qualifying commercial premises, depending on the circumstances of the tenancy and arrears.

Landlords requiring more detailed information about eligibility, the enforcement process and current costs should refer to our main Commercial Rent Arrears Recovery page or speak directly with our team before proceeding.

Need to Regain Possession of Your Commercial Property?

Recovering outstanding rent is not always the landlord’s main objective. There are circumstances where bringing the commercial tenancy to an end and recovering possession of the premises becomes the priority.

Commercial lease forfeiture may be an appropriate option where the landlord has a lawful right to forfeit. Whether forfeiture is available will depend on factors including the terms of the lease, the nature of the breach and the circumstances surrounding the property and tenancy.

Each instruction therefore needs to be considered on its own facts. A relatively straightforward commercial unit may require a different approach from a larger site, operational business premises or a property where additional enforcement considerations are present.

Absolute Enforcement can discuss the circumstances with Suffolk landlords and help determine the appropriate next steps before enforcement action is undertaken.

CRAR or Forfeiture: Which Route Should You Take?

CRAR and commercial lease forfeiture serve different purposes. CRAR normally focuses on recovering qualifying unpaid commercial rent while allowing the lease to continue, whereas forfeiture is generally aimed at recovering possession and bringing the commercial lease to an end.

The remedies should not be treated as interchangeable, and choosing one course of action can affect the availability of another.

If you are unsure whether recovering the arrears or regaining possession should be the priority, speak with our enforcement team before proceeding.

Commercial Enforcement Coverage Throughout Suffolk

Commercial property in Suffolk is distributed across a varied geographical area rather than concentrated in one location. Ipswich is a major commercial centre, while Bury St Edmunds serves an important part of the west of the county and Lowestoft provides significant commercial activity on the coast.

Felixstowe’s port and the wider transport connections around the A14 contribute to a strong logistics, warehousing and industrial presence, while Stowmarket, Haverhill, Newmarket and other established towns support their own mixture of retail, office, hospitality and employment premises.

This variety means commercial landlords may require enforcement at anything from an individual high-street unit to an industrial property, warehouse, workshop or premises within a wider business development. We can work with landlords responsible for a single commercial property as well as managing agents and property professionals overseeing larger portfolios.

Absolute Enforcement operates across England and Wales, enabling Suffolk landlords to use the same specialist enforcement provider where their property interests extend beyond the county.

I had an issue with someone claiming to provide a work visa for a friend, it was not materialising and upfront payment was not refunded. It was like a scam and i had to go through county court to get the money back as the person was not willing to repay or respond. I had applied for claim and county court provided judgement in favour of my claim and the claimant was still not repaying. The county court advised to go through one of the approved collection agency to get the money back. I had found Absolute Enforcement from the list and contacted them about my case, they advised to make an application with them to recover the money with further court order from higher court that they did for me with the county court judgement. It took about an year to go through the process and recover the money. Finally it was recovered and Absolute Enforcement provided updates on the process and progress and recovered the money as expected. So highly recommend Absolute Enforcement service for similar money claims that requires collection agency.

Company was very professional and although it was a long process all was sorted. The agents that went on the collection were very professional and fair and unbiased. Office staff kept me up to date and made frequent calls to ensure I knew what was happening during the process.
