Commercial Rent Arrears Recovery (CRAR) & Forfeiture of Lease in Wigan
Commercial Tenant Problems in Wigan? We Can Help
Dealing with a commercial tenant who has stopped paying rent can quickly become a serious issue for landlords. Whether your property is in Wigan town centre, Leigh or elsewhere across the borough, taking the appropriate enforcement route at the right stage can make an important difference.
Absolute Enforcement assists commercial landlords, managing agents and property professionals with Commercial Rent Arrears Recovery (CRAR), forfeiture of lease and other commercial enforcement matters throughout Wigan.
If your priority is recovering qualifying commercial rent while keeping the tenancy in place, CRAR may be appropriate. If your objective is to regain possession of the premises, forfeiture may instead need to be considered where a lawful right to forfeit exists.
Because these remedies serve different purposes and taking one course of action may affect another, our team can help you identify the most appropriate route before enforcement begins.
Commercial Tenant Not Paying Rent in Wigan?
Unpaid commercial rent can affect cash flow and create uncertainty for landlords, particularly where arrears continue to increase while the tenant remains in occupation.
Commercial Rent Arrears Recovery provides a statutory enforcement procedure for recovering qualifying commercial rent from tenants in appropriate circumstances. Where the statutory requirements are satisfied, CRAR can generally be used without first obtaining a court judgment.
CRAR is focused on recovering qualifying rent rather than ending the tenancy. This means the lease can remain in place while enforcement action is taken.
We can assist with CRAR instructions involving commercial premises across Wigan, Leigh and surrounding parts of the borough, helping landlords understand whether their circumstances are suitable for enforcement.
Commercial Rent Arrears Recovery (CRAR) in Wigan
CRAR may be available where a commercial tenant remains in occupation of qualifying commercial premises and rent due under the lease remains unpaid.
The procedure applies specifically to qualifying commercial rent and is carried out by Certificated Enforcement Agents in accordance with the statutory process. It should not be treated as a general mechanism for recovering every type of sum that may be owed under a commercial lease.
Wigan has a varied commercial property market, ranging from town-centre shops and offices to workshops, industrial units, warehouses and larger employment premises. Wigan Council identifies manufacturing, logistics, construction and retail among important sectors in the borough, with major employment concentrations outside the principal town centres.
Where CRAR is appropriate, Absolute Enforcement can manage the enforcement instruction from initial review through to attendance and reporting. More detailed information about eligibility and the statutory procedure is available on our main Commercial Rent Arrears Recovery page.
Need to Regain Possession of Your Commercial Property?
Recovering unpaid rent is not always the landlord’s main objective. In some circumstances, the priority may be to regain possession of the commercial premises and bring the lease to an end.
Forfeiture may provide a route to possession where the landlord has a lawful right to forfeit. Whether that right exists, and how it may be exercised, depends on the lease, the nature of the breach and the individual circumstances.
Some commercial forfeiture instructions can be relatively straightforward, while others require more detailed planning before enforcement takes place. It is therefore important not to assume that forfeiture is automatically available simply because a tenant has breached the lease.
Our team can discuss the circumstances with you and help determine the appropriate enforcement approach before an instruction proceeds.
CRAR or Forfeiture: Which Route Should You Take?
CRAR and forfeiture are different remedies with different objectives.
CRAR is generally used to recover qualifying commercial rent while allowing the lease to continue. Forfeiture is generally concerned with recovering possession and bringing the lease to an end where a lawful right to forfeit exists.
Choosing one course of action can affect the options available afterwards. If you are unsure whether recovering rent or recovering the property should take priority, speak to our team before proceeding.

Commercial Enforcement Coverage Throughout Wigan
Commercial property across Wigan is spread between busy town centres, smaller local centres and substantial employment and industrial areas. That means landlord enforcement instructions can involve very different premises and circumstances.
A case involving a retail unit in Wigan or Leigh town centre may require a different practical approach from an instruction involving a warehouse at Martland Park, an industrial unit in Ashton-in-Makerfield or commercial premises around Hindley or Atherton.
We assist both individual commercial landlords and organisations responsible for larger property portfolios, with each instruction considered according to the premises, tenancy and enforcement objective.
Our coverage is not restricted to Wigan. Where a landlord or managing agent has properties elsewhere, we can also manage commercial enforcement instructions across England and Wales.

I had an issue with someone claiming to provide a work visa for a friend, it was not materialising and upfront payment was not refunded. It was like a scam and i had to go through county court to get the money back as the person was not willing to repay or respond. I had applied for claim and county court provided judgement in favour of my claim and the claimant was still not repaying. The county court advised to go through one of the approved collection agency to get the money back. I had found Absolute Enforcement from the list and contacted them about my case, they advised to make an application with them to recover the money with further court order from higher court that they did for me with the county court judgement. It took about an year to go through the process and recover the money. Finally it was recovered and Absolute Enforcement provided updates on the process and progress and recovered the money as expected. So highly recommend Absolute Enforcement service for similar money claims that requires collection agency.Posted on Google![]()
