Commercial Tenant Problems in Brighton? We Can Help

If a commercial tenant has stopped paying rent, taking appropriate action early can help landlords protect their position and determine the most suitable way forward.
Absolute Enforcement assists commercial landlords, managing agents and property professionals across Brighton with Commercial Rent Arrears Recovery (CRAR), commercial lease forfeiture and wider enforcement matters.
For landlords whose priority is recovering qualifying unpaid commercial rent while the tenancy continues, CRAR may provide an appropriate enforcement route. Where recovering possession is the objective, forfeiture may instead be considered where the landlord has a lawful right to forfeit.
Whether the property is in central Brighton, Hove, Kemptown or elsewhere across the city, our team can discuss the circumstances and help identify the appropriate enforcement route.

Commercial Tenant Not Paying Rent in Brighton?

Unpaid commercial rent can quickly become a significant problem for landlords, particularly where arrears continue to increase while the tenant remains in occupation.
Commercial Rent Arrears Recovery (CRAR) is a statutory procedure that may allow a landlord to recover qualifying commercial rent directly from a tenant where the relevant requirements are satisfied.
A court judgment is not normally required before CRAR can be used where the statutory conditions are met. This can make it an effective option where the landlord wants to pursue qualifying rent arrears while allowing the commercial lease to remain in place.
Absolute Enforcement can assist landlords with CRAR instructions involving commercial premises throughout Brighton and the surrounding area. Detailed eligibility, procedure and current costs should be checked on our main CRAR service page.

Commercial Rent Arrears Recovery (CRAR) in Brighton

CRAR may be suitable where a commercial tenant remains in occupation and owes qualifying commercial rent under circumstances that meet the statutory requirements.
Once properly instructed, Certificated Enforcement Agents can undertake the enforcement process with the objective of recovering the qualifying rent owed by the commercial tenant.
Brighton has a varied commercial property market, ranging from city-centre shops, restaurants and hospitality premises to offices, workshops, industrial units and other business premises across areas such as Hove, Portslade and Hollingbury.
Because eligibility depends on the individual tenancy and arrears, landlords should check the main Commercial Rent Arrears Recovery page for detailed information about the CRAR process, eligibility and current costs.

Need to Regain Possession of Your Commercial Property?

Recovering unpaid rent is not always the landlord’s main objective. In some circumstances, the priority may instead be to regain possession of the commercial premises.
Commercial lease forfeiture may be an appropriate option where the landlord has a lawful right to forfeit. Whether that right exists and how it can be exercised will depend on factors including the terms of the lease, the nature of the breach and the circumstances surrounding the property.
A straightforward commercial premises may require a different approach from a larger, occupied or operational site where additional planning is needed.
Absolute Enforcement can assist landlords considering commercial forfeiture and help establish the appropriate enforcement approach. The main Forfeiture of Lease service page provides further information about eligibility and the process.

CRAR or Forfeiture: Which Route Should You Take?

CRAR and forfeiture serve different purposes. CRAR is generally used to recover qualifying unpaid commercial rent while allowing the lease to continue, whereas forfeiture is generally concerned with recovering possession and bringing the commercial lease to an end where the landlord has a lawful right to do so.
The choice matters because taking one course of action can affect the availability of another. If you are considering both rent recovery and possession, speak to Absolute Enforcement before proceeding so the circumstances can be considered and the appropriate route identified.

I had an issue with someone claiming to provide a work visa for a friend, it was not materialising and upfront payment was not refunded. It was like a scam and i had to go through county court to get the money back as the person was not willing to repay or respond. I had applied for claim and county court provided judgement in favour of my claim and the claimant was still not repaying. The county court advised to go through one of the approved collection agency to get the money back. I had found Absolute Enforcement from the list and contacted them about my case, they advised to make an application with them to recover the money with further court order from higher court that they did for me with the county court judgement. It took about an year to go through the process and recover the money. Finally it was recovered and Absolute Enforcement provided updates on the process and progress and recovered the money as expected. So highly recommend Absolute Enforcement service for similar money claims that requires collection agency.

Company was very professional and although it was a long process all was sorted. The agents that went on the collection were very professional and fair and unbiased. Office staff kept me up to date and made frequent calls to ensure I knew what was happening during the process.
